Intellectual Property Disputes

• • Representing South Korea’s leading entertainment company in successfully revocation of the decisions of the Trademark Board and Registrar on the distinctiveness of a trademark relating to a K-Pop band.
  • Representing a South Korean dessert franchise company in overturning the Board of Trademarks’ decision regarding the distinctiveness of its trademark.
  • Representing a PRC-registered solar panel manufacturer and its five directors as defendants before the Central Intellectual Property and International Trade Court (IP&IT Court) in a patent infringement dispute initiated by a competitor.
  • Representing Thailand’s leading mobile network provider in a dispute concerning a well-known service mark and tradename violation.
  • Representing a Japanese music composer in pursuing claims for music copyright infringement committed by a Thai film producer.
  • Representing a leading luxury brand in a dispute over trademark and tradename violation.

Intellectual Property Rights Enforcement

• • Compelling an infringing party to cease trademark infringement and execute a Deed of Execution within one week of receiving a cease-and-desist letter.
  • Representing an Italian consortium of cheese makers in negotiations with a Thai food manufacturer regarding the improper use of a geographical indication.
  • Liaising with the Thai Economic Police and Customs officers in conducting IP enforcement actions against infringers.

Commercial Disputes

• • Representing a full-service brokerage firm in its defense against investor claims concerning defaulted debt securities valued at THB 200 million (USD 6.1 million) that were sold five years ago.
  • Representing a Japanese construction company in connection with an internal investigation into fraud orchestrated by a senior executive.
  • Representing one of the largest and oldest state-owned commercial banks in the People’s Republic of China in connection with defaulted debt exceeding THB 1,000 million.
  • Acting as counsel for one of Asia’s largest healthcare services groups, a Moderna vaccine supplier, in a breach of contract dispute against a Thai higher education and research institution, with the potential claims exceeding USD 100 million.

Labour and Employment Disputes

• • Representing a Japanese construction company in connection with an internal investigation into fraud orchestrated by a senior executive.
  • Representing one of Thailand’s largest national petroleum exploration and production companies in connection with an internal investigation into unlawful procurement practices in the railway logistics business.
  • Representing a Japanese global apparel retailer in relation to unfair dismissal claims by employees.
  • Acting as lead counsel in advising a Japanese global apparel retailer on the preparation of its work rules and employment regulations.

Environment Disputes

• • Representing a Japanese co-owned metal casting factories in defending a nuisance claim brought by a neighboring village, with the disputed amount exceeding THB 87 million.

Administrative Disputes

• • Defending the first unicorn Thai-based logistics and courier delivery company to revoke the Trade Competition Commission’s decision concerning unfair trade practice against franchisees.

Restructuring and Insolvency

• • Representing a total of 87 savings co-operatives consisting of state-owned enterprises, universities, corporations and hospitals, the largest group of creditors of Thai Airways International Public Company Limited (THAI) in THAI’s business rehabilitation proceeding, holding an aggregate debt of THB 45.65 billion or approximately 65% of the airline’s debenture debts and 13% of the airline’s total debt.

Criminal Cases

• • Representing a Korean plastic surgery agency in defending a fraud-related criminal case.

Customs Cases

• • Representing a Japanese global apparel retailer in successfully defending against an accusation by the Customs Department regarding the alleged importation of unlicensed restricted down products into Thailand, with assessed duties exceeding THB 300 million.
