The Dispute Resolution, Litigation, and Arbitration Practice team at Kudun and Partners represented Advanced Info Service Public Company Limited (AIS) in the successful dismissal of the case brought by National Telecom Public Company Limited (NT) against AIS at the Central Administrative Court. NT had sought to overturn an arbitral award of over THB 32 billion. AIS is a major player in Thailand’s telecommunications industry and we successfully defended AIS by securing the dismissal of NT’s petition on September 22, 2023.
The case dates back to 2014 when NT initiated a dispute against AIS with the Arbitration Tribunal, seeking damages of THB 32.813 billion (approximately USD 892 million) for a contract breach related to subscriber porting to Advanced Wireless Network Company Limited’s (AWN) 3G 2100 MHz network. The Arbitration Tribunal unanimously ruled in favor of AIS, prompting NT to file a petition to set aside the arbitral award with the Central Administrative Court.
